Terms of service.
1. Application
These Terms apply to all commercial customers acquiring products and services from Fleet IQ NZ Limited (“Fleet IQ”). All products and services are supplied for business use only. The Consumer Guarantees Act 1993 does not apply.
2. Scope of Supply
Fleet IQ supplies hardware on a supply-only basis unless otherwise stated in writing. Installation, configuration, commissioning or integration services are excluded unless specifically quoted.
3. Pricing
All pricing is exclusive of GST unless stated. Freight, duty, SIM cards, data plans, installation, travel and third-party charges are additional unless specified.
4. Delivery & Risk
Risk passes to the customer upon delivery or collection. Ownership transfers once full payment for the hardware has been received.
5. Payment Terms
Payment is due in accordance with Fleet IQ’s standard credit terms. Invoices must be paid by the due date shown, and Fleet IQ may suspend further supply where accounts fall overdue. Overdue balances may attract interest at Fleet IQ’s standard commercial rate.
6. Warranty
All hardware supplied by Fleet IQ carries the standard Jimi IoT manufacturer’s warranty. The warranty covers manufacturing defects only and excludes incorrect installation, wiring, misuse, damage, water ingress, non-approved accessories, tampering, modification, or operation outside specification. Labour, diagnostic time, travel and reinstallation are chargeable unless agreed otherwise. Warranty claims must include serial number, fault description and supporting info, and remain subject to manufacturer approval.
7. Returns
Returns require prior written approval. Returned items must be unused and in original packaging. Restocking fees may apply. Custom-ordered items are non-returnable.
8. Data
Ownership & Use All footage, event data, telematics information and related IP are owned by the customer. Fleet IQ may only access or use anonymised, aggregated data for system improvement with customer consent.
9. Installation & Client-Caused Delays
Customer-arranged installers are solely responsible for workmanship. Where Fleet IQ arranges installation, customer must ensure readiness. Fleet IQ may charge delay costs where installation is obstructed by customer issues.
10. System Performance & Alerts
System assists monitoring but does not guarantee detection or prevention of unsafe events. Fleet IQ is not liable for missed events, false alerts, network interruptions, or consequential loss. Customer acknowledges obligations under the Health and Safety at Work Act 2015 remain theirs. Liability Cap: Fleet IQ’s liability is limited to the amount paid for the specific product/service. Limitation Period: Claims must be notified within 12 months.
11. Footage & Data Security
Footage is owned and controlled by the customer. Fleet IQ cannot access video unless authorised. Customer responsible for permissions, privacy obligations, and internal policies. No guarantee of footage availability. Customer responsible for downloading and retaining required footage. Fleet IQ not liable for data loss, outages or third-party breaches.
12. Security Standards
Commercially reasonable security measures are used, but absolute security cannot be guaranteed. 13. Force Majeure Neither party is liable for delays caused by events beyond reasonable control.
14. Confidentiality All pricing and documents must remain confidential unless authorised.
15. Governing Law These Terms are governed by New Zealand law
